GENERAL TERMS AND CONDITIONS OF THE BTC CITY Shop

1. General

The purpose of these General Terms and Conditions of the BTC City Shop (hereinafter: TAC) is to clearly define the rights and obligations of online users of the BTC City Shop, including any purchases or orders of the goods and services offered by the Webshop, as well as to regulate relations between BTC, d. d., (hereinafter: the Provider) and the User or customer in the Webshop.

These TAC were drafted in accordance with the Consumer Protection Act (hereinafter: ZVPot-1), the Personal Data Protection Act (hereinafter: ZVOP-2), and the Electronic Communications Act (hereinafter: ZEKom-2).

The contractual language is Slovenian.

These TAC serve as the primary and compulsory source of applying the law regulating the relationship between the Provider and the Customer, in which sense they have precedent over any other such sources and as such apply when and if any other form of written or oral conditions deviate from the conditions provided herewithin. In the event of any disagreement between these TAC and any other conditions given, these TAC are to be applied unless the Contracting Parties expressly agree otherwise in writing.

Terms used herewithin contain the following meanings:

  • The Customer or User is a natural person who is a consumer or legal or natural person who is not a consumer but who makes a purchase at https://www.shop.btc-city.com;

  • A Consumer is a natural person who acquires goods, services, or digital content for purposes transcended the needs of their work or other gainful endeavor (hereinafter used interchangeably with Costumer);

  • A Registered User is a Consumer who has created a My BTC City account through the BTC City Shop, accessing it with an email address and password;

  • A Guest is a Consumer who makes an online purchase without using their user account.

These TAC regulate the sale of goods and services available in the Webshop.

The TAC regulate e-commerce, the business relationship between Provider and Customer, and Consumer rights, considering that some such rights are granted only to Customers who are Consumers, as expressly indicated in a specific chapter below.

The provisions of these TAC referring to legal entities also apply to natural persons who are not consumers, therefore for natural persons who acquire goods, services, or digital content for purposes transcended the needs of their work or other gainful endeavor.

Purchases made in the Webshop are considered purchases concluded in accordance with the regulations valid in the Republic of Slovenia.

Consumers retain all rights according to ZVPot–1. These rights apply to marked prices and other benefits (sales, delivery methods, co-pay of postage, etc.) advertised on the day an order is submitted. Unless otherwise indicated, an item’s price applies from when it is first offered until supplies run out.

Purchases made through the BTC City Shop are accompanies by a receipt issued following payment and sent to the email address indicated upon order submission in accordance with the TAC published on this site and confirmed upon order submission.

All Webshop prices are listed in euros (€) and include value added tax (hereinafter: VAT), unless otherwise indicated. The VAT on gift cards and e-gift cards is 0%.

The TAC can change at any time or be supplemented with new provisions, wherefore the Customer should read them before each individual purchase. The Customer is bound by the TAC valid upon submission of individual order. Before submitting an order and concluding a transaction, the Customer must click to indicate familiarity and agreement with these TAC, otherwise orders may not be submitted.

The Provider undertakes to provide clear and thorough information to accurately portray products’ true characteristics. However, the images used in the Webshop are symbolic; decorative elements are not included in the price of an article or service. The Provider undertakes to provide appropriate photographic material of all the articles in its Webshop. Potential aesthetic differences between the picture and the actual item do not affect the specifications of the article itself.

2. Registering and signing in

2.1. User account

Registration is free of charge and is not binding, amounting just to entry into a database, where the Customer provides the requested information and agrees to the TAC after indicating familiarity with their content. This creates for them a My BTC City user account (hereinafter: User Account), and the user becomes a Registered User. Registration means that all the required information have already been entered in the database and that the User’s email address has been confirmed. After initial registration, each subsequent login requires the entry of just email address and password, which the User can change at any time.

Registration is not a condition for making purchases in the Webshop, but Registered Users can take advantage of certain benefits and advantages, such as monitoring account balances on the BTC City Gift Card or Atlantis Gift Card (hereinafter: Gift Cards), easy order submission, regular information on special deals and sales, account history, receipt archive, e-ticket archive, etc.

Purchases can be made in the Webshop without a User Account by acting as a guest, but certain information is nonetheless needed to conclude transactions.

2.2. Registering a User Account

Users can make a User Account during registration by entering in the required information. My clicking the right field during registration, the User confirms that they have carefully read the entirety of the TAC and that they accept and agree with all of them, further confirming that the User is at least 15 years of old and fulfills all the other conditions for making an online purchase indicated within these TAC. The User can register a User Account at https://www.shop.btc-city.com, or during the process of making a purchase in the Webshop.

Successful registration gives Users the opportunity to make purchases in the Webshop, review purchase history, and access an archive of gift cards, e-tickets, receipts, and transactions. Required information is necessary for further steps in the registration process and for business communication with Registered Users, as well as for other types of processing in accordance with the purpose and legal bases; such information is marked by an asterisk or by a text indicating that a field is mandatory. If the User chooses not to submit any of the required information when registering a User Account, such registration will not be possible and purchases can be made merely as a guest, as described above herein.

2.3. Cancelling registration

The User can cancel or deactivate their User Account at any time by writing an email to [email protected] with the subject “preklic”. After confirming cancellation, such User Account will be deactivated. User Accounts cannot be uncancelled, but in accordance with the TAC, the User can make or register a new User Account. The User is responsible for accessing their own account and must protect their user data and passwords. The User ensures that all submitted data and information are accurate, assuming responsibility for any damages that might be incurred as the result of inaccurate or false information.

5. Prices

All Webshop prices are listed in euros (€) and include value added tax (hereinafter: VAT), unless otherwise indicated. The prices do not include shipping or delivery fees or postal costs, which are calculated and added to the total order cost before user confirmation.

The prices are valid only for W purchases. Prices listed online may differ from prices indicated in regular price lists or other sales at the Provider’s physical stores or other sales channels. The Provider reserves the right to change prices at any time with no prior notification.

Prices are considered valid at the time of order, more specifically the prices that were valid when the Provider’s information system received and confirmed the order. Discounts on particular articles or services may not be combined with discount codes. A sales contract is concluded between the Provider and User the moment an order is confirmed. From that point, all prices and other conditions become immutable, becoming binding for both Provider and Customer.

6. Purchase process

6.1. Product or service presentation

Every product or service in the BTC City Shop is displayed or presented with basic information, along with additional information if the product or service is of a special nature. Such information includes the product name, picture, short description, long description, additional characteristics (usage date, color, size, etc.), and price.

6.2. Completing purchases

Purchases are possible 24 hours a day, 7 days a week in the Webshop, whose language is Slovenian. The Customer can choose products and services from those listed in the Webshop.

The purchase process is simple and can be concluded as a Registered User or as a guest, by entering the necessary personal information before submitting each individual order.

Having a User Account gives you access to all former orders and streamlines subsequent online orders with auto-fill, as well as other functionalities.

Purchasing as a guest obviates the need for a User Account or for registering and/or logging into a User Account.

Ordering is easy as described in the steps below.

6.3. Shopping cart

Shopping carts track the products and quantities chosen. You can check the content of your shopping cart at any time.

If the Customer still has not registered and logged into the Webshop, they will need to choose a method of continuing with the purchase – either as guest or Registered User.

If the Customer chooses to continue by registering a User Account, they will be redirected to a secure link with a form on which they will create a User Account with unique username and password. If they choose to continue as a guest, they will be redirected to the next step in concluding a purchase and will enter the necessary personal information.

6.4. Delivery

The Provider generally sends or prepares ordered items within 3–5 business days from receiving payment. Submitted orders are processed Monday through Friday until 13:00; orders submitted after that are processed on the following business day. In the event of a delay in delivery, the Customer will be informed as such by email.

Customers receive e-gift cards and Atlantis e-tickets by the indicated email immediately following payment.

The Provider reserves the right not to process a purchase for a Customer whose identify the Provider cannot identify due to incomplete, incorrect, or falsified information.

The Provider is not responsible for damage, destruction, or inability to deliver products that arises due to force majeure.

The delivery crew at BTC City’s sales points (Info Point, Dvorana A, BTC City Ljubljana, and Atlantis) reserves the right to reasonably verify the recipient’s ID (comparing order numbers, asking for ID, etc.) in order to ensure that goods are delivered to the right person. Packages may only be accepted by third parties on the basis of advance written authorization and the recipient’s showing of a valid ID. The Customer indicates receipt of the goods with a signature.

The Provider will deliver the ordered goods within the Republic of Slovenia in accordance with the valid price list for shipping, which equals €2.95 before VAT.

Goods can also be picked up in person at the Info Point, Dvorana A, BTC City Ljubljana, from Monday to Saturday, 09:00 to 20:00. Personal pick-up is not possible on Sundays and holidays.

6.5. Payment method

Payment can only be made in the Webshop as a one-time fee. Several different payment methods are available. The Customer can choose their preferred method from the following:

  • MasterCard or Visa,

  • BA Maestro debit card,

  • Flik.

After order submission and payment, the content of an order cannot be changed, nor can the final amount due be changed, as it is considered already concluded.

Legal entities can complete Webshop purchases only through an invoice.

Customers can access their receipt at any time through their My BTC City account, and it will also be sent to the email address indicated upon order submission.

6.5.1. Legal entities – paying by invoice

Legal entities can pay for purchases in the Webshop through invoice by choosing the “Legal entity” tab during purchase and filling out the required information. After submitting an order, the Provide will send within 24 hours or the next business day an invoice with all the information necessary for payment. The invoice must be paid within 7 days. If the Provider fails to receive payment within the due date, it will assume the order has been cancelled.

After receiving payment, the Provider will send the receipt to the indicated email address, along with a notice about its status. The original address and an itemized receipt will be included in physical form in the actual package.

Ordered e-tickets to Atlantis will be sent along with the receipt to the indicated email address.

6.6. Concluding purchases

When confirming orders, the Customer indicates with a click that they agree entirely with and accept the TAC, and that they are over 15 years of age and a court has not ruled them incapable of making business transactions. After concluding their purchase, the Customer will receive an email with all the details about their order and delivery.

The Provider reserves the right to partially or fully refuse to fulfil an order if supplies are out or if the provision of a certain service is no longer possible, if it determines too great a financial risk for the Customer, if the order was not concluded in accordance with the TAC, or if there was an obvious mistake in the price listed. In all of these and similar examples, the Provider will inform the Customer as such immediately.

6.7. Issuing receipts

The Provider must issue and give to the Customer a receipt upon delivering goods or services. The Webshop issues a receipt upon receiving payment; specifically, it generates a PDF that is accessible through the User’s My BTC City account and that is sent to the email address indicated during order submission.

When paying by invoice (only for legal entities), the receipt is printed and included in the order summary along with the package, as well as generated electronically to be accessed through the My BTC City account and sent to the indicated email address.

7. Range of products and services

The range of products and services offered through the BTC City Shop includes various categories. Each item contains information on availability, as well as a description and price. The categories are:

  • BTC City (gift cards and e-gift cards),

  • Atlantis (gift cards, e-gift card, e-tickets, etc.).

8. Discount codes

Discount codes give the Customer various benefits during purchases and are for a limited time. Both registered users and guests can use discount codes.

9. Terminating this Agreement

The Customer can terminate this Agreement in accordance with Article 134 of ZVPot–1.

As determined by that provision, the Customer can, within 14 days, inform the Provider that they choose to cancel their order without indicating a reason. The Customer indicates such intent by filling out a form (such form and the form containing information on exercising the consumer right to terminate an agreement are supplements to these TAC), or with an unambiguous statement clearly indicating their intent to terminate the agreement. The Customer is considered to have submitted the termination notice within statutory limits if it is submitted within the deadline indicated for terminating Agreements in Article 136 of ZVPot–1. The Customer bears the burden of proof in exercising this right.

The Customer can send this statement by email to [email protected], by mail to BTC, d. d., Ameriška ulica 2, 1000 Ljubljana, or in person at the Info Point, Dvorana A, BTC City Ljubljana, within the working hours indicated at www.btc-city.com.

The Customer is considered to have met the deadline if the statement was submitted at the latest on the 14th day following the product’s receipt.

The Customer can cancel their order anytime from its fulfilment to the expiry of the deadline indicated. They can cancel their order even if they have not yet received the product.

The only cost the Customer bears in terminating an agreement is the cost of returning the product, either by post or other carrier service, or in person, to Info Point, Dvorana A, BTC City Ljubljana.

Payment will be refunded to the customer as soon as possible, or within 14 days of when the Provider receives the returned goods or proof that the Customer has returned the goods.

The Customer must return the goods if they terminate the Agreement. They can return the goods directly to the Provider or to an authorized third party. The goods must be returned immediately upon submitting a termination notice, or at the latest within 14 days of submitting such a notice.

The Provider will cancel the validity of e-gift cards and e-tickets immediately upon receiving the Customer’s termination notice or intent to terminate, such that the Customer can no longer redeem them.

The customer can return the item to:

BTC, d. d., PE BTC City, Grška ulica 3, 1000 Ljubljana.

By agreeing with these TAC, the Customer expressly agrees that, in the event of a late submission of termination notice, they forfeit all right to terminate this Agreement if the Provider fulfilled it in its entirety.

10. Complaints

10.1. Product discrepancies

An item is considered commensurate with its advertising if it:

  • matches the description, type, quantity, and quality, and has the functionalities, compatibility, interoperability, and other characteristics outlined in the sales agreement;

  • performs a specific function that the Customer requires, about which the Customer informed the Provider no later than during the conclusion of the sales agreement and to which the Provider agreed;

  • is delivered along with any accessories or instructions, including installation instructions, as indicated in the sales agreement and

  • is updated, as indicated in the sales agreement.

A product’s quality is checked by comparing it against another, perfect example of the same product, as well as against the manufacturer’s indications on that product. A designated court expert also helps make such comparisons.

The Customer can exercise their right to terminate an agreement due to faulty goods only after informing the Provider as such, specifically under the conditions and in the order set out below:

  • the Customer requests the product quality be rectified, either through repair or replacement;

  • the Customer requests a discount or refund commensurate with the product’s defects, or terminates the agreement and requests a full refund.

To rectify a product’s quality, the Provider gives the Customer the choice of repairing the product or replacing it with a new one.

The Customer can exercise their warranty claims rights if they inform the Provider of potential defects within the statutory deadline. In doing so, the Customer must describe the error or defect in detail and allow the Provider to inspect the product.

Warranty claims are voided if they arise from a defect caused by the Customer. Such defects caused by the Customer include but are not limited to:

  • damage from a third party,

  • improper usage,

  • mechanical damage,

  • unauthorized attempts at repair.

The Customer can request that, within a reasonable deadline no longer than 30 days after informing the Provider about a product defect, that the Provider rectify the quality for free with no undue unpleasantness for the Customer, keeping in mind the product’s nature and the purpose for which the Customer requires it. This deadline can be extended by the minimum amount of time needed to finalize such rectification, but no longer than 15 days. When deciding on extending a deadline, the product’s nature and complexity are considered, as well as the nature and severity of the defect, and the amount of resources needed to finalize the rectification or replacement. The Provider must inform the Customer about potential deadline extensions within the original 30-day deadline.

The Customer has the right to make a claim about a product defect within 2 months of finding such defect. The Customer must inform the Provider about such defect and give the Provider the chance to inspect the product. If the defect’s existence is questionable, the Provider informs the Customer as such within 8 days of receiving a warranty claim. The Customer can inform the Provider about defects in person or by email. If the Customer terminates the agreement due to a product defect, the Provider will immediately refund the paid amount, at the latest within 8 days of receiving the product back or receiving proof that the Customer has returned it. The customer can return the item to: BTC, d. d., PE BTC City, Grška ulica 3, 1000 Ljubljana.

The Provider is liable for product defects in accordance with legislative provisions. Customers are protected by consumer protection legislation, even if they do not adhere to the rules listed below. The Provider is not liable for any product defects demonstrated after 2 years from date of purchase.

Complaints about product defects can be made immediately in person when picking the product up, or subsequently by emailing [email protected] or showing up at the Info Point, Dvorana A, BTC City Ljubljana, during the working hours listed at www.btc-city.com.

10.2. Errors in digital content

Digital content or services are considered to abide by the agreement on providing digital content or services if they:

  • match the description, type, quantity, and quality, and has the functionalities, compatibility, interoperability, and other characteristics outlined in the agreement on providing digital content or services;

  • perform a specific function that the Customer requires, about which the Customer informed the Provider no later than during the conclusion of the agreement on the provision of digital content or services, and to which the Provider agreed;

  • are delivered along with any accessories or instructions, including installation instructions, as well as customer support, as indicated in the agreement on the provision of digital content or services and

  • are upgraded as described in the agreement on providing digital content or services.

In the event of faulty digital content or services, the Customer can:

  • request rectification of faulty digital content or services,

  • request a commensurate refund or

  • terminate the agreement on providing digital content or services.

These Customer rights cease to be valid after 2 years from the day the Customer informed the Provider about the faulty digital content or service.

10.2.1. Terminating the agreement on providing digital content or services

If the Provider fails to provide digital content or services, the Customer must notify them as such and call on them to provide it. If even after such Customer notification and request the Provider still has not provided digital content or services without undue delay or within the extended deadline, which was set in direct agreement with the Customer, the Customer may terminate the agreement on providing digital content or services.

Regardless of the provisions of the previous paragraph, the Customer can immediate terminate the agreement on providing digital content or services if:

  • the Provider says or it can reasonably be shown from the circumstances that the Provider will not provide digital content or services;

  • the Provider makes an agreement with the Customer or it is clear from the circumstances in which an agreement was concluded that the delivery of digital content or services is time-sensitive for the Customer, but the Provider has not provided such content or services within such time.

If the Customer terminates the agreement on providing digital content or services, the Provider refunds all payment issued in accordance with the agreement on the provision of digital content or services. If a Customer exercises a claim for commensurate refund or termination of agreement on the provision of digital content or services, the Provider refunds any received payment without undue delay, at the latest within 14 days from the day of making the claim for commensurate refund or terminating said agreement. The Provider does not charge the Customer anything for reimbursing received payments.

After terminating the agreement on providing digital content or services, the Customer refrains from using such content or service and does not make it available to third parties.

11. Security

Online purchases are completely secure. This is ensured with the most cutting edge measures and methods of protecting confidential information. Personal and transactional information is transferred securely with an SSL (Secure Sockets Layer) protocol. Data are coded and transferred in a secure format onto the Provider’s server. Thus the system prevents anyone from intercepting personal and transactional information that Customers send to the Webshop.

Secure authorizations and transactions with payment cards and Flik are ensured by the 3D Secure 2.0 protocol, or by another strong authentication method determined by the issuer of the payment means. Cards and Flik are authorized in real time with immediate verification of data in the bank system.

The purchase is further ensured to be secure by following all legislative obligations and recommendations.

When using a payment card, the system temporarily redirects the Customer to a special payment page, where all data is additionally protected using SSL technology.

The information the Customer provides for the purposes of making a purchase or during registration is securely stored by the Provider and is not given to any third party under any circumstances.

All confidential information transmitted online is properly encoded, making it impossible to be deciphered by a third party. To this effect, Provider uses SSL (Secure Sockets Layer) technology and a 256-bit encryption key in online transactions.

For credit and payment cards, the Provider uses the Bankart transaction system, so information on the Customer's credit or payment cards is sent via a secure connection directly to Bankart’s authorization center, without ever being stored in the Provider's webshop under any circumstances.

The Customer can verify with their payment card provider whether online payment is enabled on the specific card to be used.

12. BTC City privacy policy

The Provider realized the importance of protecting personal data, wherefore it undertakes to securely acquire and process such information.

When placing an order in the Webshop, the Customer must provide certain personal information, which the Provider will process in accordance with the privacy policy, and the Customer, by submitting such personal data when placing an order, agrees to the processing of such information in accordance with the Privacy Policy.

12.1. The personal data collected

In order to register or create a My BTC City user account, the Customer must provide the following mandatory personal data: first name, last name, e-mail address, and password. Phone number is considered optional information.

BTC will process such data for the following purposes:

  • contacting Registered Users in order to provide seamless services outlined in these TAC,

  • logging into User Accounts,

  • providing the products and services outlined in these TAC and concluding agreements with Registered Users.

As regards registering a User Account, BTC also processes agreement with these TAC and the Privacy Policy, and will process data only on the basis of written consent for the following purposes:

  • profiling Registered Users in order to offer them tailored products and services by email,

  • directly marketing products, services, sales, and benefits, or otherwise communicating changes or new developments,

  • profiling Registered Users for market research on product and service quality, or on the need to expand product ranges,

  • conducting and reviewing payment transactions, reviewing possible inconsistencies in transactions, and reviewing related abuses and other violations of these TAC.

  If the Customer concludes a purchase as a guest, they must provide the Provider with their personal data: name, surname, telephone number, address and place of residence, e-mail address.

BTC will process such data for the following purposes:

  • contacting users in order to provide seamless services outlined in these TAC,

  • providing the products and services outlined in these TAC and concluding agreements with guests,

  • conducting and reviewing payment transactions, reviewing possible inconsistencies in transactions, and reviewing related abuses and other violations of these TAC.

13. Disclaimer

The content in the BTC City Shop may be used and reproduced only for non-commercial purposes, and all copyright and related rights notices must be preserved.

BTC undertakes to provide the most up-to-date and accurate content in its Webshop, but it does not assume any responsibility for the currentness and/or accuracy thereof, nor is it responsible for the Webshop’s occasional unavailability.

Users are responsible for their own use of the content published therein.

Neither BTC nor any other company or person who took part in the creation or the production of this Webshop bears any responsibility for any damage that could arise from accessing or the inability to access this information in the Webshop, use or inability to use the information on this website, nor for any mistakes or issues regarding the content. However, this provision does not exclude liability for damage caused intentionally or through negligence caused to a User, who is considered a Consumer in accordance with consumer rights legislation.

The Webshop uses independent external services and applications to display certain functionalities. The use of these services is subject to the terms of use of external services determined by the owner of such service or application.

Photos and videos shown online are symbolic and do not guarantee the product’s exact properties.

Users are responsible for all activities carried out using their User Account or email address.

The User must immediately notify the Provider in the event of any such unauthorized use or reasonable suspicion that such access has occurred. The Provider waives liability for any damage the User might incur due to the unauthorized use of their User Account or the password with which it is registered, or due to the unauthorized use of the User's email address.

The User undertakes to use the Webshop in accordance with these TAC, to ensure the confidentiality of passwords, and to follow the rules and notifications found on the Webshop https://www.shop.btc-city.com.

The Provider waives responsibility for potential errors and damage resulting from the transmission of incorrect data and/or other actions on the User's part, e.g. when registering or logging into the Webshop.

BTC reserves the right to change, add, or remove content published in the Webshop at any time and without prior warning. All Users are responsible for their own use of the published content, including keeping secure the information on their computer or similar device.

13.1. Complaints and Conflicts

The Provider respects and adheres to valid legislation regarding consumers’ rights. The Provider undertakes to the best of its ability to fulfill its duty to establish an effective system for processing complaints. The Customer can contact the Provider using the contact information listed below, by phone and/or e-mail, or in person at the Info Point in Dvorana A, BTC City Ljubljana.

Contact information:

The provider realizes that consumer conflicts, at least in terms of judicial resolution, come at a disproportionately larger cost than the typical value of the item at the heart of the complaint. This cost is also the main reason consumers tend not to launch judicial proceedings. It is in this light that the provider undertakes to the best of its ability to resolve all potential conflicts amicably and extrajudicially; if this proves impossible, the competent court will be responsible for conflict resolution.

13.2. Extrajudicial conflict resolution – for Consumers

For Provider/Customer relations arising from these TAC, the Provider does not recognize providers of extrajudicial consumer conflict resolution as competent in matters whose resolution the Consumer could initiate in accordance with the applicable legislation regulating such extrajudicial consumer conflict resolution.

13.3. Online Dispute Resolution platform – for Consumers

As a provider engaged in online sales, BTC publishes a link to the Online Dispute Resolution platform. The platform can be found at http://ec.europa.eu/odr.

13.4. Final and transitional provisions

The Provider reserves the right to change these TAC at any time.  

The currently valid TAC can be found at shop.btc-city.com/.

Before submitting an individual order through the Webshop, Users must read and confirm their agreement with the TAC’s content, otherwise they will be unable to conclude purchases or submit orders.

These TAC enter into force and shall be applied from September 2023.

14. Contact
